The 2013 -2014 Legal Compliance Committee has been established to obtain a Nonprofit New York attorney to interpret the July 1, 2013 New York Nonprofit Law and current Federal Laws as they apply to Gold Star Wives of America, Inc. to ensure the organizations compliance. The attorney will be requested to review the organization’s legal compliance of our New York State Incorporation documents, Internal Revenue Service 501 (C ) (4) tax exempt status, Federal Charter, current Constitution, Bylaws, and Standing Rules, all legal contracts, and insurance policies of the organization. In addition, a Nonprofit Certified Public Accountant will review and advise the organization of any compliance requirements.


Based upon the findings of the attorney and accountant retained, the committee will prepare recommendations for the organization’s Board of Directors immediate review and action for any changes to meet the current New York Nonprofit Law’s and annual reporting requirements and the current Internal Revenue Service’s nonprofit tax exemption qualifications. The committee’s recommendations will include a point of contact for any legal compliance issues, the physical location of the organization’s records in the State of New York, annually retaining a nonprofit New York attorney to represent the organization and continue legal compliance reviews, utilization of the organization’s nonprofit certified public accountant, and the establishment of a Best Practices Governance and Conflict of Interest policy for the organization.
